Ningxia Combats Domestic Violence

To crack down on domestic violence, and to protect the legal rights and interests of victims of domestic violence, Yinchuan (capital of Northwest China's Ningxia Hui Autonomous Region) Intermediate People's Court, Yinchuan municipal bureaus of Public Security and Civil Affairs and Yinchuan Women's Federation recently promulgated the (Trial) Measures of Implementing Yinchuan's System of Enforcing Restraining Orders.[For Women of China]

 

To crack down on domestic violence, and to protect the legal rights and interests of victims of domestic violence, Yinchuan (capital of Northwest China's Ningxia Hui Autonomous Region) Intermediate People's Court, Yinchuan municipal bureaus of Public Security and Civil Affairs and Yinchuan Women's Federation recently promulgated the (Trial) Measures of Implementing Yinchuan's System of Enforcing Restraining Orders (to protect the safety of domestic violence victims).

The measures contain regulations on the orders' application, enforcement and the penalties to be imposed on those who violate the regulations. The measures also define the responsibilities of public security agencies, civil affairs departments, people's courts and women's federations, at all levels in Yinchuan, in eliminating domestic violence. For example, the measures stipulate the courts should deliver—on the day when they issue restraining orders (to  victims of domestic violence)—the orders to the applicants and the respondents.

The courts should also deliver the orders to public security agencies, civil affairs departments, women's federations and other organizations. The measures also stipulate victims, who are seriously injured and/or who face the threat of personal safety, may apply to public security agencies, civil affairs departments or women's federations for shelter.

In accordance with the measures, if a respondent (of domestic violence) is proven to have broken the law, the respondent should be investigated for criminal responsibility, in accordance with the law. Those with minor violent behavior, which does not constitute a crime, should receive, from public security agencies, reprimand, fines, detention and/or other administrative punishments. If the respondents are proven to have seriously violated the regulations of restraining orders, the courts may include their names on the List of Dishonest Persons Subject to Enforcement.
