Officials in central China's Henan implement the Special Provision on Labor Protection of Female Employees from November 1, according to a recent announcement.
The Provision contains 22 articles which were based on the special regulations on labor protection of female employees that issued by the State Council, and the local situations in Henan, say officials.
The scope of the application of the Provision has been made more accurate. It specifies that the labor protection in Henan will be implemented for female employees in government departments, social groups, enterprises and institutions, individual economic organizations and other social organizations.
Second, governments at county level or above are required to strengthen their leadership in labor protection for female employees and coordinate the settlement of major issues.
Relevant administrative departments are required to supervise and administer employers to implement the labor protection guidelines for female employees according to their respective duties.
The Provision gets employers' legal obligations clearly specified. Men and women should get equal pay for equal work. The labor protection system for female employees should be established and improved.
It is prohibited to cut wages, dismiss, alter labor contracts or dissolve employment contracts due to female employees' pregnancy, child birth and breastfeeding, according to the document.
Third, female employees will enjoy more comprehensive and fairer labor protection. Employers should take good care of those female employees who are on their period, pregnant, breastfeeding and/or going through the menopause.
The Provision also includes detailed regulations on vacations, maternity allowances and medical expenses.
Employers are required to provide a monthly allowance of 35 yuan or more for each female employee and arrange annual gynecological exams that focus on breast and cervical cancer.
Fourth, for female employees with special needs, some details are specified. One or two break days should be given to those who have menstrual cramps or those who are on a heavy period.
The document requires that pregnant employees who have a history of miscarriage should be allowed to take rests or temporarily leave the post which may lead to miscarriage.
Special care should be given to female employees that give birth to infants with poor health conditions. Breastfeeding periods should be extended if a mother's baby is diagnosed as a frail infant over one year old.
The Henan provincial Party committee and government will pay great attention to the implementation of the provisions to offer a legal guarantee and to promote rule of law and social development, according to a spokesperson.
